Li'an in Islam

SUMMARY: A man accused his wife of adultery and invoked a curse upon her. Allah's Messenger then gave instructions to determine the paternity of the child she was expecting.

Muhammad (one of the narrators) reported: I asked Anas b. Malik (Allah be pleased with him) knowing that he had a knowledge of (the case of li'an). He said: Hilal b. Umayya (Allah be pleased with him) accused his wife with the charge of fornication with Sharik b. Samha, the brother of al-Bara'b Malik from the side of his mother. And he was the first person who invoked curse (li'an) in Islam. He in fact invoked curse upon her. Allah's Messenger said: See to her if she gives birth to a white-complexioned child having dark hair and bright eyes; he must be the son of Hilal b. Umayya; and if she gives birth to a child with dark eyelids, curly hair and lean shanks, he must be the offspring of Sharik b. Samha. He said: I was informed that she gave birth to a child having dark eyelids, curly hair and lean shanks.
وَحَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا عَبْدُ الأَعْلَى، حَدَّثَنَا هِشَامٌ، عَنْ مُحَمَّدٍ، قَالَ سَأَلْتُ أَنَسَ بْنَ مَالِكٍ وَأَنَا أُرَى، أَنَّ عِنْدَهُ، مِنْهُ عِلْمًا ‏.‏ فَقَالَ إِنَّ هِلاَلَ بْنَ أُمَيَّةَ قَذَفَ امْرَأَتَهُ بِشَرِيكِ ابْنِ سَحْمَاءَ وَكَانَ أَخَا الْبَرَاءِ بْنِ مَالِكٍ لأُمِّهِ وَكَانَ أَوَّلَ رَجُلٍ لاَعَنَ فِي الإِسْلاَمِ - قَالَ - فَلاَعَنَهَا فَقَالَ رَسُولُ اللَّهِ ‏ "‏ أَبْصِرُوهَا فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبِطًا قَضِيءَ الْعَيْنَيْنِ فَهُوَ لِهِلاَلِ بْنِ أُمَيَّةَ وَإِنْ جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ ابْنِ سَحْمَاءَ ‏"‏ ‏.‏ قَالَ فَأُنْبِئْتُ أَنَّهَا جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ

EXPLANATIONS:
This hadith is about a practice called li’an in Islam. It is when a husband accuses his wife of adultery and invokes a curse upon her. In this case, Hilal b. Umayya accused his wife with the charge of fornication with Sharik b. Samha and invoked the curse on her. Allah's Messenger then gave instructions to determine the paternity of the child she was expecting by looking at its physical features such as complexion, hair color and eyesight. If it had dark eyelids, curly hair and lean shanks it would be from Sharik while if it had white-complexioned skin with dark hair and bright eyes it would be from Hilal. In this way justice could be served without any doubt or confusion as to who was responsible for raising the child if indeed there was an act of adultery committed by either party involved in this case. This hadith teaches us that justice should always prevail over personal feelings or emotions when dealing with matters related to family life or relationships between spouses so that no one is wrongfully punished or held accountable for something they did not do.
