Rights of Women in Marriage

SUMMARY: A woman who has been previously married has more right to her person than her guardian, and a virgin should be consulted before marriage and her silence implies consent.

Ibn Abbas (Allah be pleased with them) reported Allah's Messenger as saying: A woman who has been previously married (Thayyib) has more right to her person than her guardian. And a virgin should also be consulted, and her silence implies her consent.
وَحَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا سُفْيَانُ، عَنْ زِيَادِ بْنِ سَعْدٍ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ، سَمِعَ نَافِعَ بْنَ جُبَيْرٍ، يُخْبِرُ عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ قَالَ ‏ "‏ الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ وَإِذْنُهَا سُكُوتُهَا
