Rights of Women in Marriage

SUMMARY: A woman without a husband has more rights to her person than her guardian, and a virgin's consent must be asked before marriage and her silence implies consent.

Ibn 'Abbas (Allah be pleased with him) reported Allah's Apostle as saying: A woman without a husband has more right to her person than her guardian, and a virgin's consent must be asked from her, and her silence implies her consent.
حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، وَقُتَيْبَةُ بْنُ سَعِيدٍ، قَالاَ حَدَّثَنَا مَالِكٌ، ح وَحَدَّثَنَا يَحْيَى، بْنُ يَحْيَى - وَاللَّفْظُ لَهُ - قَالَ قُلْتُ لِمَالِكٍ حَدَّثَكَ عَبْدُ اللَّهِ بْنُ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ قَالَ ‏ "‏ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا ‏"‏ ‏.‏ قَالَ نَعَمْ
