The question needs to be answered in its proper context. If the woman is married legally the laws of that country will determine her fate (whether the country is Muslim or not). However, I am assuming you live in the West and your question concerns a religious divorce and not a legal one. A man has the right to unilaterally terminate the Islamic marriage as long as he fulfills his obligations (e.g. pay the �mahar�, support the children, etc). A woman has the same right if she asked for it in her marriage contract. However, most women do not ask for this right. Such women must have valid cause for divorce or they must get �khule� which is to compensate the man in order to break the marriage contract. An unregistered Islamic Marriage is very hard to enforce in the West. However, people should not forget that the Islamic marriage contract is made in the name of Allah. He will hold both parties responsible for their conduct during the marriage and at its termination. It is better to give up points in a divorce than risk the wrath of God. |

What happens if a woman is divorced over the phone while she is staying at her parents home? Is she supposed to return to her husband's home until the waiting period is completed? Also, what are the laws regarding the woman staying away from her home because of disagreement? Is there a maximum period for a woman to stay away from her home during disagreement with her husband?
