My fatwa against the terrorists' creed

I have been compelled to issue a fatwa - a comprehensive theological refutation of Islamist terrorism - because of what has been happening in Pakistan over the past year. Terrorists are bombing mosques during Friday prayers, they are burning schools, killing women. They are digging bodies out of graves, cutting off their heads and hanging the bodies from trees.

My 600-page fatwa is based on all four schools of jurisprudence: Hanafi, Shafii, Hanbali and Maliki, and the Shia school of Jafari. I have consulted hundreds of classical Islamic texts, the scholars, fiqh and the Hadith. The main theme is this: any act of terrorism such as suicide bombing cannot be justified in any way. There are no conditions, no pretexts or exemptions. It is condemned by the Quran and the Sunna.

Killing Muslims and non-Muslims through terrorist activities and using violent aggression to impose their mistaken and misplaced ideology is a fundamental rejection of faith. Such acts make the people carrying out the attacks unbelievers, or kufr. 

Some scholars have said to me that we know suicide bombing is forbidden but to say that this is an act of an unbeliever is going far. I am not saying anyone who kills is an unbeliever. I say one who is committing acts of terrorism on the basis that it is sanctioned and lawful by Islam is an unbeliever.

The Quran says those who kill in mosques, burn people, blow them up, they will suffer the torments of hellfire. This is one aspect. 

A second aspect I have examined is the justification that Muslim rulers in Arab countries or non-Muslims are not enforcing Islamic law so there is an obligation to fight against them. This is absolutely wrong. In no context is any organisation allowed to take up arms on their own and say we are defending Muslim land or we are avenging the aggression of non-Muslim powers. This is a matter for a state and its government.

The holy Prophet Mohammed told his companions that bad rulers would come and the people would curse them and the rulers would curse their people. The companions asked should they not fight them with swords if this time comes? And the holy Prophet said that no, they were not allowed as far as they were Muslims.

As for adopting the defence that the attacks are against foreign aggression, this is the privilege and responsibility of the state to stand up and to fight according to international law. If groups and individuals start taking revenge it will create global anarchy and there will be no rule of law, there will be just killing of mankind.

There is a prophecy of the Prophet Mohammed. He mentioned that the Kharijites would emerge continuously in Islamic history. The Kharijites believed that whoever did not agree with their philosophy was an unbeliever and should be killed. They wanted to resolve everything through the sword and through power. They rose up in the time of the rightly guided Caliphs, Usman and Ali, and fought against them.

This hadith, which appears in dozens of books, says the holy Prophet Mohammed said they would emerge again and again in different centuries until the final time of the anti-Christ. They would arrive more than 20 times. They would keep changing names and appear for the last time as part of the anti-Christ's army. They would slaughter people. 

Al Qa'eda is an old evil with a new name. They are the Kharijites with a new name. They are misguided today like the Khawarij youth were misguided at that time. They were brainwashed although they were religious people who prayed and fasted.

Those who have already decided to become suicide bombers are totally brainwashed. I exclude them from this discussion because they are blind. I am trying to reach the majority who have not reached that stage but have extremist tendencies and are proceeding in that direction.

There are thousands of extremists running websites and applying misguided ideas. The radicals who have no access to classical authorities are misguided and give the wrong concept of jihad. This religious ruling is particularly important for Britain and the western world, where the majority of Muslims are of south Asian origin. 

We have seen examples of extremist groups targeting vulnerable young people from these communities to carry out their acts of violence - from training them as suicide bombers to brainwashing students across British universities. I am sure that the hundreds of authorities I have quoted will allow them to rethink, to see that whatever they were taught was wrong.

The fatwa has appeared in Urdu, and English and Arabic translations have been started. It will be translated into many other languages and distributed through the internet accompanied by videos, summaries and talks. We will do whatever is possible to reach the youth with the Almighty Allah's help and grace. 

Already it is happening. We have been contacted by the Afghan president Hamid Karzai's office and they want a copy to translate into Persian and Pashto. And so it will go.

There have been many other fatwas that condemn suicide bombings and there have been verbal resolutions against it. They were very brief, maybe one or two pages signed by hundreds of scholars and they did not contain many references. These brief declarations were not able to answer the questions or address all the concerns. I thought there was a need to address every major concern, every major and minor aspect which has already been planted in people's minds.

In Pakistan, some religious scholars have condemned the military action in the Swat valley and North-West Frontier Province, or they have said they already have condemned suicide bombings and acts of terrorism. Some have felt they have fulfilled their duty. But by simply condemning the Pakistani military action or staying silent they are creating doubt in the minds of the common people and youth.

While Muslims resist and fight terrorism and are not ready to accept its remotest possible link with Islam, there are some who are also seen supporting it. Instead of opposing and condemning it openly they confuse the issue.

After this fatwa more scholars will become courageous and stand up. 

A few are scared. A friend of mine who recently condemned suicide bombing in Pakistan was assassinated. 

This grand fatwa, when it is in the hands of everybody, will give people courage, clarity and motivation.

    Leading Islamophobes and Zionists have naturally welcomed Dr. Qadri's one-dimensional fatwa, condemning suicide bombing and terrorism. There was hardly any reference to the context; the ongoing Anglo-US-Israeli terrorism over the last three decades that has resulted in occupation, theft of land and natural resources, and numerous massacres of innocent Muslims (Sabra and Shatila, Qana, Jenin, Lebanon, Gaza, Fallujah, Highway of Death going towards Basra, etc). Far from a fatwa, it looks like the typical spin of a nasty neo-conservative.

    If the subject of the fatwa is terrorism, then he should at least define this elusive term; according to Dr. Qadri, terrorism is targeting non-combatants, whereas 'legitimate' war mean targeting combatants. It is strange for man claiming to have scholarly credential, to come up with such a simplistic view of war and terrorism, which bears no relation to the real world. The methods of warfare have 'evolved' from the days of spears and swords, and with the use of explosives over populated cities, substantial 'collateral' damage is guaranteed; war means the mass killing of civilians.

    Even a mediocre academic recognises the pseudo distinction between, terrorism of non-state actors and wars waged by state. To be succinct -wars waged by states is mass terrorism with a big budget, whereas terrorism is war on a smaller budget. Both acts involve the killing of civilians, driven by a political motive. Therefore, one can wage war for democracy or for the implementation of Sharia laws. To label one category of violence, as terrorism has no intellectual merit, it is just for political convenience.

    First of all, this writer's identity must be presented to all with photo and vital bio-data. Fatwa-makers come and fatwa-makers go. We need to know who this one is. He could be a CIA agent for all we know or a fake "character" being used to ferret out the views of Muslim readers..

    Secondly, if any individual expounds the sins of one side and ignores all similar crimes of others then he is being a petty propagandist. He is not a sincere believer in Justice, Peace and the welfare of human beings.

    Thirdly, and most importantly, Allah Almighty's punishment to hypocrites is far worse than that for non-believers/non-Muslims/kaffir (refer the Qur'anic verse/ayah for this reference. We will all be held responsible for every word, every action that we indulge in. Let this writer beware!

    If there are people shaking their heads and hanging them out of axis even for this balanced view, something has gone wrong in the so called Muslim mentality (I say so called Muslims because they do not reflect well built view in expression nor balanced conducts in daily walks and are contrary to real Muslim behavior).

    One can not eat the fruit of death and blame the tree of life as being fruitless because he did not avail it when he ate the fruit of death!! Repent all ye shaking heads in dilemma! There is no justification in justifying violence. It is urgent for Muslims to unite and propagate ISLAM on the planet earth. Then only it will be called as beautiful religion of peace. {And to me Islam means: ISA + ASLAM, ISA + SALAAM - (Christ is good, Christ is peace or peace of Christ).     Whether one page or a thousand pages, I totally agree with this article, there is no place in Islam for terrorism, all we need to do as Muslims is study the life of our beloved Prophet and Messenger Muhammad (pbuh). Did he ever sanction such behavior?? Did he ever blow up a Masjid with Muslims inside (subhanallh!!), what about did he ever kill an entire family because someone of that family was torturing his followers? Well what about did he ever just kill someone for no reason at all, because he was just frustrated because justice was too slow in coming and life was not going his way? Don't tell me what the Jew is doing, I'm not Jewish nor Christain. I follow Islam, not those religions. What we have is weak and ignorant Muslims who cannot embarce the beauty of their religion, they remain in constant battle, killing innoncent men, women, children, Muslim and Non-Muslim, they have truly gone insane. They are following Satan, using his 'tools' and following his plans. They have made the world think that Islam is the worst religion on earth and that it gives nothing but death and destruction and not light, knowledge and culture like it use to in centuries gone by.     The fatwa will come one after the other. Another mulla will issue 1500 page fatwa, another with 3000 page but terrorism will still be there. My opinion: The only way is Thableegi Jamat, which stress 'Apni Islah'. I have seen lots of people have changed their mind from bad to good, by going in Thableeg Jamat trips.

    As much as I agree with fatwa agaisnt terrorism, it fall short condeming western form of terrorism. It seems that soemthing is phiching though. The fatwaa doent give any solution. It's also easy for Muslims in the West to condem or find fault with Muslims in Middleeast and Africa and elsewhere when they themselve have never experience seige and being bombed by air strikes by foreign forces while they live in war free zone. Defense is legitimate in any form. Take Palestine for instance, should they just be quiet while being bombed by Israeli machines daily? It is true that only Kalifar is allowed to give fatwa (for Jihad) against oppression but where is Kilafar?. The Sheik also didnt even border to condem Western terrorism. Even if there is an end to sucide bombings, would it put stop to West occopation of the East?. Taliban for instance said few months ago that all they need it Islamic state of Afghanistan ( whats up with that)?.But did that stop NATO and Allies from the occupation?. Am scare of this fatwa. It's dangerious. It also says that karzai needs a copy of the fatwa( to contain Mujahideen). Who is he, isnt puppet?. Uhmm am afraid that Western govt backs this fatwa (which is what it is) and if that is the case, I personally reject it.     As-salaamu alaikum...I see many things wrong with this article. First, the terms that you are using are not islamic nor arab terms. The words 'Islamist' does not even exist. If it does please kindly give me the definition of this word. Next, this word 'al-Qa'eda' it has an arab definition, but no one in the Islamic World has ever heard of this until after 9-11 when the US needed a reason to attack Afghanistan and Iraq better yet Islam. Secondly, you have to watch where you get your news (read surah 49:6), look at where the news comes from secret sources and lies(please read 3:118). We must not let the enemies of Allah and all that is good dictate our Islam and what we believe. As in who are the believers to fight just read surah Ma'idah(surah 5) and there many other like it in the Qur'an and Hadith. And Allah has indeed spoke the truth. Whoever wrote this article is clearly misguided and needs to take at what Allah has written.
